TERMS & CONDITIONS
- General
1.1 Pakistan Festival is an event organized by the Spirit Trust Foundation, located at Nico Koomanskade 218, Rotterdam.
1.2 These general terms and conditions apply to all visitors, participants, suppliers, and other parties involved in the Pakistan Festival, which takes place on August 10, 2024, in The Hague. - Purchase of Tickets
2.1 When the Visitor purchases a Ticket for an Event organized by the Organizer, the payment and dispatch are usually handled by a third party, such as Ticketpoint. This third party may have its own general terms and conditions that apply to the payment and dispatch of the Ticket. The Organizer is not responsible for the content of those terms.
2.2 The Organizer, who manages the Website, is not liable for errors, malfunctions, or defects in or during the payment by these third parties, on the Website and/or on the third party’s website. - Access and Security
3.1 Access to the Pakistan Festival is only possible with a valid ticket. Tickets are personal and non-transferable.
3.2 The Ticket entitles the holder to attend the Event. Only the holder of the Ticket who presents the Ticket first at the start of the Event will be granted access. The Organizer may assume that the holder of this Ticket is also the rightful owner. The Organizer is not required to conduct further checks on valid Tickets. The Visitor must ensure that they remain the sole holder of the Ticket issued by the Organizer or an authorized (pre)sale address.
3.3 Visitors must always follow the instructions of the organization and security staff.
3.4 Persons under 18 years old are denied access.
3.5 The organization reserves the right to deny access to individuals who misbehave or do not comply with these general terms and conditions. - Safety and Health
4.1 Visitors are required to comply with all safety and health regulations, including any COVID-19 related measures.
4.2 It is prohibited to bring dangerous objects to the event grounds, including weapons, explosives, fireworks, and other items that pose a safety risk. - Search and Camera Surveillance
5.1 The Organizer has the right to search Visitors and their baggage before entering and/or during the Event. Visitors who do not comply may be denied entry or immediately removed without refund.
5.2 Cameras may be present to record the area/location where the Event takes place for supervision and safety. - Prohibited Items
6.1 It is forbidden to bring professional photo, film, drone, and/or audio equipment (unless expressly stated otherwise on the Website), glassware, plastic bottles, (alcoholic) drinks, selfie sticks longer than 1.5 meters, food, drugs (including those listed on the Opium Act schedules I and II), nitrous oxide (cartridges), cans, fireworks, animals, weapons, and/or dangerous objects (including but not limited to aerosols or CS gas) to or possess them at the Event location. Seized items will not be returned.
6.2 Visitors who violate this prohibition may be denied further access without refund or may be removed from the Event and/or handed over to the police. The Organizer has the right to destroy confiscated items. - Denial of Access
7.1 The Organizer reserves the right to deny access or remove individuals from the Event and/or hand them over to the police to maintain public order and safety during the Event and/or if any provision of these Terms is violated. This also applies if the Organizer considers that a Visitor’s clothing, texts, or symbols are offensive, discriminatory, insulting, or could incite aggression or disturbance, or do not meet the Organizer’s dress code, and for undressing during the Event (including but not limited to a bare torso). The Organizer may also deny access if there is reason to believe the Ticket is counterfeit. Visitors who are denied access or removed have no right to compensation or ticket refund. - Liability
8.1 The organization is not liable for loss, theft, or damage to visitors’ personal belongings.
8.2 Visitors enter the event grounds at their own risk. The organization is not responsible for any injury or damage incurred during the event. - Conduct and Order
9.1 Visitors must behave respectfully and orderly. Discrimination, intimidation, violence, and other forms of undesirable behavior are not tolerated.
9.2 Drug use and excessive alcohol consumption are prohibited. Persons visibly under the influence may be denied access or removed from the premises. - Sales and Promotion
10.1 Unauthorized sales of goods, promotional activities, and distribution of promotional materials are prohibited without written permission from the organization.
10.2 The organization reserves the right to revoke this permission at any time. - Photo and Video Material
11.1 Taking photos and videos for personal use is allowed. Commercial use of photo and video material is only permitted with written consent from the organization.
11.2 By entering the event, visitors grant the organization permission to use photos and video material for promotional purposes. - Program Changes
12.1 The organization reserves the right to change the program. Changes do not entitle a ticket refund.
12.2 In case of event cancellation due to force majeure, the organization will endeavor to provide an alternative without being obliged to refund tickets. - Cancellation or Postponement in Case of Force Majeure
13.1 In case of force majeure, including illness and/or cancellation of artists, strikes, pandemics, terrorist threats, cancellation orders by authorities, fire, (bad) weather conditions, etc., the Organizer has the right to reschedule or cancel the Event.
13.2 The Organizer is not liable for damage caused by cancellation or rescheduling as mentioned above. The Organizer will inform about the rescheduling or cancellation as deemed appropriate. - Electronic Payment
14.1 The Organizer may use an ‘open loop’ and/or ‘closed loop’ electronic payment system during the Event, allowing Visitors to pay via card transactions instead of (or alongside) tokens.
14.2 If the Visitor wishes to pay with cash, the Organizer may offer a ‘closed loop’ system. Visitors can deposit cash at the Event cashier onto a specific payment card for the Event.
14.3 No refund of the remaining balance on the payment card will be provided during or after the Event. The Organizer is not liable for loss or theft of the payment card. - Vendors at an Event
15.1 Visitors may be offered products and/or services by Third Parties with stands at the Event, such as drinks, food, merchandise, or other products like sunglasses or clothing or operators of (fairground) attractions.
15.2 Although the Organizer carefully selects these Third Parties, it is not a party to any agreement between the Visitor and these Third Parties. The Organizer is not liable for any damage arising from the Visitor’s purchase or acquisition of a product or service, including a (fairground) attraction from these Third Parties.
15.3 Visitors indemnify the Organizer against any claims for costs or damages arising from an agreement between the Visitor and these Third Parties.
15.4 The Third Parties’ general terms and conditions, if applicable, are available from these Third Parties. - Final Provisions
16.1 These General Terms and Conditions are governed by Dutch law.
16.2 Disputes arising from these General Terms and Conditions will be submitted to the competent court in The Hague.
